General Provisions<\/span><\/strong><\/p>\n

1.1. These terms and conditions of purchase\/sale (hereinafter referred to as the “Terms”) are a legally binding document for the Parties, establishing the rights, duties, and responsibilities of the Buyer and the Seller when the Buyer purchases goods from the Park Avenue online store.<\/span><\/p>\n

1.2. The Seller reserves the right to change, amend, or supplement these Terms at any time in compliance with legal requirements. The Buyer will be informed of any changes on the Park Avenue online store website. The Terms applicable at the time of placing the order will apply to purchases made on the Park Avenue online store.<\/span><\/p>\n

1.3. The right to purchase from our online store is granted to:<\/span><\/p>\n

1.3.1. Legally competent individuals, i.e., individuals who have reached the age of majority and whose legal capacity is not restricted by court order;<\/span><\/p>\n

1.3.2. Buyers who are at least 20 years old. If the Buyer is not 20 years old or cannot provide proof of age, the Buyer’s order will be canceled;<\/span><\/p>\n

1.3.3. Legal entities;<\/span><\/p>\n

1.3.4. Authorized representatives of all the above-mentioned persons.<\/span><\/p>\n

1.4. The contract between the Buyer and the Seller is considered concluded from the moment the Buyer forms a shopping cart in the Park Avenue online store, indicates the delivery address, selects the payment method, reviews the Seller’s Terms, and clicks the “Confirm Order” button (see the section “Order Placement, Prices, Payment Procedures, and Deadlines”).<\/span><\/p>\n

1.5. Each contract concluded between the Buyer and the Seller is stored in our online store.<\/span><\/p>\n

Privacy Policy and Personal Data Protection<\/span><\/strong><\/p>\n

2.1. When ordering goods, the Buyer must provide the necessary personal data for order fulfillment in the information fields provided by the Seller: name, surname, exact delivery address, phone number, and email address.<\/span><\/p>\n

2.2. By confirming these Terms, the Buyer agrees that the personal data provided under clause 2.1 will be processed for the purpose of selling goods\/services, analyzing Park Avenue Seller activities, and direct marketing.<\/span><\/p>\n

2.4. By agreeing that the Buyer’s personal data will be processed for the purpose of selling goods\/services in the Seller’s online store, the Buyer also agrees to receive informational messages necessary to fulfill the order at the provided email address and phone number.<\/span><\/p>\n

2.5. The Buyer, upon registering in the online store and ordering goods, undertakes to keep login data confidential and not disclose it to anyone.<\/span><\/p>\n

2.6. The Buyer agrees that the personal data provided voluntarily in the registration form will be processed in accordance with these Terms.<\/span><\/p>\n

2.7. The Buyer has the right to access their personal data and the right to request correction of inaccurate, incomplete, or incorrect personal data, block, or delete it by sending an email to restoranas@park-avenue.lt.<\/span><\/p>\n

2.8. Our online store may use Buyer’s information for marketing purposes, internal analysis of the online store’s operations, and improving the quality of services and product assortment.<\/span><\/p>\n

2.9. The Buyer has the right to request the correction, destruction, or suspension of their personal data processing, except for storage. This includes receiving promotional and informational messages. By registering, the Buyer agrees to receive newsletters and similar materials, which they have the right to opt out of.<\/span><\/p>\n

Buyer’s Rights and Obligations<\/span><\/strong><\/p>\n

3.1. The Buyer has the right to purchase goods from Park Avenue in accordance with these Terms and other information sections of this online store.<\/span><\/p>\n

3.2. The Buyer undertakes to accept the ordered goods and pay the agreed price.<\/span><\/p>\n

3.3. If the data provided in the Buyer’s registration form changes, the Buyer must update it immediately. The Buyer loses the right to make any claims regarding incorrect order fulfillment if incorrect data is provided and not corrected within 12 hours.<\/span><\/p>\n

3.4. By using the online store, the Buyer agrees to these purchase-sale Terms and undertakes to comply with them and not violate the laws of the Republic of Lithuania.<\/span><\/p>\n

Seller’s Rights and Obligations<\/span><\/strong><\/p>\n

4.1. The Seller undertakes to provide all conditions for the Buyer to properly use the services provided by the online store.<\/span><\/p>\n

4.2. The Seller is not responsible for delays in delivery by shipping services.<\/span><\/p>\n

4.3. The Seller has the right to cancel the Buyer’s order without prior notice if the Buyer does not pay for the goods within 24 hours or one business day.<\/span><\/p>\n

4.4. The Seller has the right, without prior notice, to suspend or terminate the registration, order execution, and\/or use of the online store services if there is reason to believe that the Buyer is engaging in illegal activities or otherwise attempting to harm the Seller’s online store operations or stability.<\/span><\/p>\n

4.5. The Seller undertakes to respect the Buyer’s right to personal information specified in the online store’s registration form.<\/span><\/p>\n

4.6. The Seller undertakes to deliver the ordered goods to the address specified by the Buyer.<\/span><\/p>\n

4.7. In unforeseen circumstances, the Seller may temporarily or permanently suspend the online store’s operations without prior notice to the Buyer.<\/span><\/p>\n

Order Placement, Prices, Payment Procedures, and Deadlines<\/span><\/strong><\/p>\n

5.1. The Buyer can purchase goods from the Park Avenue online store 24 hours a day, 7 days a week, unless the online store is unavailable due to technical work.<\/span><\/p>\n

5.2. The contract comes into effect when the Buyer clicks the “Confirm Order” button, and the Seller confirms the order by sending a confirmation email to the Buyer’s specified email address.<\/span><\/p>\n

5.3. The prices of goods in the online store and in the formed order are indicated in euros, including VAT.<\/span><\/p>\n

5.4. The Seller is not responsible if the goods in the online store do not match the actual size, shape, or color of the goods due to the Buyer’s display settings. Additionally, the Seller is not responsible if the goods are used improperly.<\/span><\/p>\n

5.5. The Buyer pays for the goods by bank transfer or via the Paysera payment system.<\/span><\/p>\n

Goods Delivery<\/span><\/strong><\/p>\n

6.1. The Buyer undertakes to pick up the ordered goods at the Park Avenue restaurant, located at Perk\u016bno al. 4, Kaunas. Goods are temporarily not shipped by mail or courier services.<\/span><\/p>\n

6.2. If the person collecting the goods is not 20 years old, the goods will not be handed over, and the order will be canceled.<\/span><\/p>\n

6.3. For delivery of goods outside Lithuania, please contact us at restoranas@park-avenue.lt for delivery conditions and costs, which we will provide to you personally.<\/span><\/p>\n

Goods and\/or Money Return and Exchange<\/span><\/strong><\/p>\n

7.1. Defective goods are exchanged or returned in accordance with the rules approved by the Minister of Economy of the Republic of Lithuania on June 29, 2001, Order No. 217 and on August 17, 2001, Order No. 258. Money for returned goods is refunded only to the payer’s bank account.<\/span><\/p>\n

7.2. To return goods based on clause 7.1 of the Terms, the Buyer can do so within 14 (fourteen) calendar days from the day of delivery by sending a request to restoranas@park-avenue.lt.<\/span><\/p>\n

7.3. The request should indicate the order number, the name of the product to be returned or exchanged, and the reason(s) for the return or exchange.<\/span><\/p>\n

7.4. When returning goods, they must be in their original, orderly, undamaged packaging; the product must not be damaged or used, and must retain its commercial appearance. The returned product must be in the same configuration as received; if gifts were received with the purchase, they must also be returned.<\/span><\/p>\n

7.5. Money is refunded to the bank account no later than 7 business days from the day the goods are received back in the warehouse.<\/span><\/p>\n

7.6. The Seller has the right not to accept goods returned by the Buyer if the Buyer does not comply with the established return procedure.<\/span><\/p>\n

7.7. If the Seller does not have suitable goods for replacement, the amount paid will be refunded to the Buyer within 7 business days.<\/span><\/p>\n

Marketing and Information<\/span><\/strong><\/p>\n

8.1. The Seller may initiate various promotions in the online store at its discretion.<\/span><\/p>\n

8.2. The Seller has the right to unilaterally change the conditions of promotions or cancel them without separate notice.
